Terms of Use

1. Agreement to These Terms

These Terms of Use ("Terms") are a binding agreement between you and Search Engine Optimization & Advertising, Inc. ("BothAnswer," "we," "us"), the operator of BothAnswer.com (the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent that you are 18 or older and legally able to enter into this agreement. The Service is not directed to minors, and we do not knowingly permit their use of it.

3. What the Service Is — and Is Not

BothAnswer is a conversation tool. It presents questions to two people, compares their independent answers, and displays areas of alignment and difference. The Service does not evaluate, endorse, or make decisions about any relationship. Nothing in the Service — including compatibility scores, category readings, dealbreaker alerts, astrology content, or AI-generated summaries and suggestions — constitutes advice of any kind. The Service is not therapy, counseling, psychological assessment, medical care, legal advice, or financial advice, and it is not a substitute for any of those. If you need professional support, consult a qualified professional.

4. No Responsibility for Relationship Decisions or Outcomes

You and your partner are solely responsible for all decisions you make about your relationship, including decisions to begin, continue, change, or end it. You agree that we have no liability whatsoever for any decision, action, conversation, disagreement, separation, or other outcome — emotional, financial, or otherwise — arising from or related to your use of the Service or its results. Scores and outputs are automated comparisons of the answers you and your partner choose to provide; they may be incomplete, inaccurate, or unsuited to your circumstances, and you agree not to rely on them.

5. AI-Generated and Astrology Content

Portions of the Service may be generated by artificial intelligence or based on astrological frameworks. AI outputs can be wrong, incomplete, or misleading, and astrology content is provided for entertainment and conversational purposes only. Neither is a statement of fact about you, your partner, or your relationship, and neither should be relied upon for any decision.

6. Accounts, Invitations, and Shared Results

You are responsible for the accuracy of the information you provide, for maintaining access to your email account, and for whom you invite to a session. By completing a session, you understand and agree that your answers will be revealed to the person paired with you in that session once both of you finish, and that we are not responsible for how that person uses, shares, or reacts to your answers.

7. Your Content

You retain ownership of the answers and other content you submit. You grant us a limited license to store, process, and display that content solely to operate and improve the Service as described in our Privacy Policy. You represent that your content does not violate any law or third-party right.

8. Acceptable Use

You agree not to use the Service to harass, deceive, or harm any person; to impersonate another person or complete a session on someone else's behalf without their knowledge and consent; to access another person's answers except through the Service's intended reveal mechanism; to probe, disrupt, or reverse engineer the Service; or to violate any applicable law. We may suspend or terminate access for violations.

9. Payments

Certain features may require payment. Prices, billing terms, and refund terms will be disclosed at the point of purchase. Except where required by law, payments are non-refundable.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT ANY RESULT, SCORE, OR SUGGESTION IS ACCURATE, COMPLETE, OR SUITABLE FOR YOU.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW: (A) IN NO EVENT WILL BOTHANSWER, ITS OWNERS, OFFICERS, EMPLOYEES, OR CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, GOODWILL, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATING TO THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES; (B) OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF FIFTY U.S. DOLLARS (US $50) OR THE AMOUNTS YOU PAID US IN THE TWELVE (12) MONTHS BEFORE THE CLAIM AROSE; AND (C) THESE LIMITATIONS APPLY REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE). SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

12. Indemnification

You agree to indemnify and hold harmless BothAnswer and its owners, officers, employees, and contractors from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service, your content, or your violation of these Terms or any law.

13. Termination

You may stop using the Service and request deletion of your account at any time. We may suspend or terminate your access at any time for any reason, including violation of these Terms. Sections that by their nature should survive termination (including Sections 4, 7, and 10 through 15) survive.

14. Governing Law and Disputes

These Terms are governed by the laws of the State of Arkansas, without regard to conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Benton County, Arkansas, and you consent to their jurisdiction.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be indicated by updating the effective date below, and continued use of the Service after changes take effect constitutes acceptance. If you do not agree to updated Terms, stop using the Service.
